UPDATE 2/25: GOP nixes the Dems sneak attack in the bill; Democrats more concerned about terrorist “phobias” and sleep deprivation than defending American lives

Today, while the Obamacare kabuki theatre was well into its purposeless discussions, the Democrats in the House were busy making sure that our country is less safe from the actions of terrorists who wish us dead.

The Obama Democrats have outdone themselves.

While the country and the Congress have their eyes on today’s dog-and-pony show on socialized medicine, House Democrats last night stashed a new provision in the intelligence bill which is to be voted on today.  It is an attack on the CIA: the enactment of a criminal statute that would ban “cruel, inhuman and degrading treatment.”

(As an aside–I watched almost the entire Obamacare summit today, so I feel really dirty and a little worn after watching Dems pull out their healthcare sob stories about people that supposedly exist.  I also grew quite tired of Obama’s pursed lips and defensive posture each time Eric Cantor or Paul Ryan clearly stated the discrepancies in the bill versus the rhetoric from Obama’s lips.)

So….I won’t comment any further on this intelligence bill article.  Andy McCarthy at National Review sums it up very well.  Here is the rest of his piece (my emphasis):

The provision is impossibly vague — who knows what “degrading” means? Proponents will say that they have itemized conduct that would trigger the statute (I’ll get to that in a second), but it is not true. The proposal says the conduct reached by the statute “includes but is not limited to” the itemized conduct. (My italics.) That means any interrogation tactic that a prosecutor subjectively believes is “degrading” (e.g., subjecting a Muslim detainee to interrogation by a female CIA officer) could be the basis for indicting a CIA interrogator.

The act goes on to make it a crime to use tactics that have been shown to be effective in obtaining life saving information and that are far removed from torture.

 “Waterboarding” is specified. In one sense, I’m glad they’ve done this because it proves a point I’ve been making all along. Waterboarding, as it was practiced by the CIA, is not torture and was never illegal under U.S. law.  The reason the Democrats are reduced to doing this is: what they’ve been saying is not true — waterboarding was not a crime and it was fully supported by congressional leaders of both parties, who were told about it while it was being done. On that score, it is interesting to note that while Democrats secretly tucked this provision into an important bill, hoping no one would notice until it was too late, they failed to include in the bill a proposed Republican amendment that would have required full and complete disclosure of records describing the briefings members of Congress received about the Bush CIA’s enhanced interrogation program. Those briefings, of course, would establish that Speaker Pelosi and others knew all about the program and lodged no objections. Naturally, members of Congress are not targeted by this criminal statute — only the CIA.

More to the point, this shows how politicized law-enforcement has become under the Obama Democrats. They could have criminalized waterboarding at any time since Jan. 20, 2009. But they waited until now. Why? Because if they had tried to do it before now, it would have been a tacit admission that waterboarding was not illegal when the Bush CIA was using it. That would have harmed the politicized witch-hunt against John Yoo and Jay Bybee, a key component of which was the assumption that waterboarding and the other tactics they authorizied were illegal. Only now, when that witch-hunt has collapsed, have the Democrats moved to criminalize these tactics. It is transparently partisan.

In any event, waterboarding is not defined in the bill. As Marc Thiessen has repeatedly demonstrated, there is a world of difference between the tactic as administered by the CIA and the types of water-torture methods that have been used throughout history. The waterboarding method used by the CIA involved neither severe pain nor prolonged mental harm. But it was highly unpleasant and led especially hard cases like Khalid Sheikh Mohammed (i.e., well-trained, committed, America-hating terrorists) to give us information that saved American lives. The method was used sparingly — on only three individuals, and not in the last seven years. The American people broadly support the availability of this non-torture tactic in a dire emergency. Yet Democrats not only want to make it unavailable; they want to subject to 15 years’ imprisonment any interrogator who uses it.

What’s more, the proposed bill is directed at “any officer or employee of the intelligence community” conducting a “covered interrogation.” The definition of “covered interrogation” is sweeping — including any interrogation done outside the U.S., in the course of a person’s official duties on behalf of the government. Thus, if the CIA used waterboarding in training its officers or military officers outside the U.S., this would theoretically be indictable conduct under the statute.

Waterboarding is not all. The Democrats’ bill would prohibit — with a penalty of 15 years’ imprisonment — the following tactics, among others:

– “Exploiting the phobias of the individual”

– Stress positions and the threatened use of force to maintain stress positions

– “Depriving the individual of necessary food, water, sleep, or medical care”

– Forced nudity

– Using military working dogs (i.e., any use of them — not having them attack or menace the individual; just the mere presence of the dog if it might unnerve the detainee and, of course, “exploit his phobias”)

– Coercing the individual to blaspheme or violate his religious beliefs (I wonder if Democrats understand the breadth of seemingly innocuous matters that jihadists take to be violations of their religious beliefs)

– Exposure to “excessive” cold, heat or “cramped confinement” (excessive and cramped are not defined)

– “Prolonged isolation”

– “Placing hoods or sacks over the head of the individual”

 Naturally, all of these tactics are interspersed with such acts as forcing the performance of sexual acts, beatings, electric shock, burns, inducing hypothermia or heat injury — as if all these acts were functionally equivalent.

In true Alinskyite fashion, Democrats begin this attack on the CIA by saluting “the courageous men and women who serve honorably as intelligence personnel and as members of our nation’s Armed Forces” who “deserve the full support of the United States Congress.” Then, Democrats self-servingly tell us that Congress “shows true support” by providing “clear legislation relating to standards for interrogation techniques.” I’m sure the intelligence community will be duly grateful.

Democrats also offer “findings” that the tactics they aim to prohibit cause terrorism by fueling recruitment (we are never supposed to discuss the Islamist ideology that actually causes terrorist recruitment, only the terrible things America does to provide pretexts for those spurred by that ideology). These “findings” repeat the canards that these tactics don’t work; that they place our captured forces in greater danger (the truth is our forces captured by terrorists will be abused and probably killed no matter what we do, while our enemies captured in a conventional war will be bound to adhere to their Geneva Convention commitments — and will have the incentive to do so because they will want us to do the same); and that “their use runs counter to our identity and values as a nation.”

 Unmentioned by the Obama Democrats is that officers of the executive branch have a solemn moral duty to honor their commitment to protect the American people from attack by America’s enemies. If there are non-torture tactics that can get a Khalid Sheikh Mohammed to give us information that saves American lives, how is the use of them inconsistent with our values?

 Here is the fact: Democrats are saying they would prefer to see tens of thousands of Americans die than to see a KSM subjected to sleep-deprivation or to have his “phobias exploited.” I doubt that this reflects the values of most Americans.

Well, House Republicans were on the ball and tonight, they forced the intel bill that contained the stealth measure to be pulled…..

…….House Republicans charged Democrats with trying to sneak a provision into the intelligence authorization bill that would establish criminal punishment for CIA agents and other intelligence officials who engage in “cruel, inhuman and degrading treatment” during interrogations.

Democrats inserted an 11-page addition into the bill late Wednesday night as the House Rules Committee considered the legislation….

…..Republicans criticized the language and the way it was introduced.

“This will fundamentally change the nature of the intelligence community by creating a criminal statute governing interrogations,” said Rep. Pete Hoesktra (R-Mich.).

He added that it had appeared “out of nowhere” in a manager’s amendment.

I penned a message to Obama that I would like to deliver now. Because Mr. Obama, I think it’s time we had a heart to heart talk. Let me be the father that you never had or never really knew, because I think you need some guidance. It’s time to man up. It’s time to grow up. That speech last night was an embarrassment. You couldn’t focus, you lashed out in all directions, you refused to accept responsibility for your own actions, and you were angry.

And he was, folks! He was mad. Being president is a big job. It’s a big responsibility. You wanted the position, Barack. You campaigned for it. You told the public to trust you with it, and they elected you — and you’re now president of the greatest country mankind has ever known, and yet you act like this was all coming to you, like you deserve it, that you’re better than the people you are supposed to serve and that you have no tolerance for debate or dissent. That’s not the way it works as president, Barack. We have a Constitution, we have checks and balances, we have separation of powers, we have states — and most of all, we have the people. You don’t get to impose your programs and policies on the nation and the people without our consent.

This is a representative republic, not a banana republic, and let me remind you: Karl Marx and Saul Alinsky are not our Founding Fathers. This is a nation built on individuality, built on liberty, free markets, and faith. Yet you, Barack, demand fidelity to a different belief system: A system that crushes individual initiative and free will. The president does not berate Supreme Court justices who are guests of the Congress and who have no ability to respond to your attacks. You’ve made such a mess of things, Barack, and it’s time to stop deluding yourself. It’s time to stop blaming others. You are delusional. You are delirious. It’s time for you to assume the responsibilities of a president rather than pretending to be one.

It amazes me that with all the talk about your ability to persuade and communicate, that you can’t even hold your own party members together anymore. Is that Bush’s fault, too? Is it is fault of the banks and the insurance companies and the lobbyists that you can’t keep your own Democrat Party unified — or is it a problem with your leadership, Barack, or lack of leadership? It’s the latter, Mr. President. I’ll tell you, you are not a leader. You are an agitator and an organizer, and a process guy, but you are not a leader. It is you who are doing something wrong.

The people in Virginia don’t like it. The people in New Jersey don’t like it. The people in Massachusetts don’t like it. The people in Massachusetts and all over the country have the ability to inform themselves outside of your sycophant press corps, and they are doing so. Members of your own governing majority don’t like what you are doing. I mean, this calls for some self-reflection and some circumspection. Has it occurred to you, Mr. President, even once that you’re not as cool as you think you are? Has it occurred to you that you are screwing up? And if it has, are you happy about that? Has it occurred to you that you have a great deal to learn and that you need to take your own measure, or are you Mr. Perfect? Are you God-sent?

Are you The One that you’ve been waiting for? See, I have a little concern there may be a psychological issue at play here. I don’t say this to demean you, Barack. I say it because I’m concerned. I mean, Tom Daschle was always “concerned” and I like the word. I’m concerned. You seem to have a whole lot of enemies, at least in your own mind. A partial list would include Fox News, insurance companies, banks, oil companies, the “special interests,” the Supreme Court, Republicans, talk show hosts, executives, anyone or any business that earns over $250,000 a year, mortgage companies, credit card companies — and the list goes on and on and on. You have the longest enemies list of anybody I’ve ever known.

These people are not your enemies, though, Barack. They are Americans. They are part of this country. They are part of what makes the nation work. You are not. You have nothing to do, and have had nothing to do, with this nation’s greatness. You can’t lay claim to greatness on any scale, not even rhetorical. But you have no direct relationship to the greatness of this country. You are damaging the possibility of further greatness. Nevertheless, like a bully, you continue to threaten all of these people. The Supreme Court, Big Oil, Big Pharmaceutical, Big Retail, talk show hosts, Fox News, the list goes on. You threaten anybody who does not agree with you. You try to intimidate them. You smear them. Your sycophantic media goes right along and carries your water. But this is not what presidents do…

Now all of the libs out there will persecute Rush for conveying his opinion about Obama very pointedly. Of course, those same libs are praising Obama today for a State of the Union Speech that was low on truth and respect and high in the amount of condescenscion Obama rained down on the American People, Congress, Republicans, Banks, Private Industry and the Supreme Court.

And there are those on the right who will wring their hands in worry about the “tone” of Rush’s words. You know…we don’t want to be like the Left are when berating George W. Bush at every turn.

But it must be remembered that when a strong statement is made about Obama, it is not the same as the lies that were perpetuated (and still are) about George W. Bush. Those lies encompassed false stories about Bush’s intentions for the war, his prosecution of the war, and almost everything Bush achieved while in office.

But, the BIG difference between what the Libs have done to Bush and what Rush has clearly stated to Obama is that the Libs had to lie about Bush. And then perpetuate the lies.

What Rush has laid out about Obama is becoming more and more clear to many Americans every day. Obama’s contempt for our country, its Constitution, its tradition and people who don’t praise his Far Left agenda is clear.
GW Bush has never had contempt for America or its people.

“Scoring” the Obama School Speech: Propaganda wins convincingly


Michelle Malkin, AllahPundit at HotAir, and Patterico are now reporting that the Dept of Education has now whitewashed the original supporting “teaching” documentation that they sent out to schools.

The original documentation had the following:

As one of the preparatory materials for teachers provided by the Department of Education, students had been asked to, Write letters to themselves about what they can do to help the president. “

From HotAir.com, the revised version reads:

 “Write letters to themselves about how they can achieve their short‐term and long‐term education goals.”

Regardless, I had a “HOPEful” commenter that just doesn’t understand what all the hub-bub’s about. 

It got me to thinking (and counting). 

The DOE summary info says the following about Obama’s speech:

“In advance of this address, the Department of Education is providing resources developed by and for teachers to help engage students and stimulate discussion “about persisting and succeeding in school.”

So it is about PERSISTING and SUCCEEDING in school?  Yea, right.

If you don’t believe that Obama wants to get a specific message out to kids that is more about him and his “community over individual” morality then think about this —

Supposedly Obama’s speech is about success and academics, but…..

The supporting study documentation originally sent out to teachers contains these words followed by the number of times used in the documentation:

Success, Succeeding, Succeed – 0 (zero)
Persist, Persisting, Persistence – 0 (zero)
Academic, Academics – 0 (zero)
Education – 2 times (plus once used in Dept of Education!)

But the following do appear, some numerous times:

President or Obama – 18 times
Do (in the sense of “doing” something) – 8 times
Community – 3 times
Duty – 1 time
Civic – 1 time

Score?

Community and “duty” Propaganda/Obama personality worship – 31
Education and Success – 2

If the Department of Education had to revise some of its words from a focus on the President to focus of education, those of us skeptical of Obama’s actions may have our point validated by that alone!

Obama’s Department of Education circumvented elected officials when sending September 8th information


Obama is planning an unprecedented “speech” to our public school children on September 8.  This basically became wide spread knowledge yesterday and the speech is planned on or near the first day of school in many areas.

I have had commenters say their Principals were unaware of this speech….my kids’ teachers were also not aware, but I have not heard from the Principal yet.

So is this just clumsy handling by the Department of Education or a concerted effort to get this in near the beginning of school (so parents are uninformed) and bypassing district decision-makers?

I am a conservative school board member in the Atlanta area…

It is very important to note that the DOE sent letters directly to the Principals of every public school in the country – Completely bypassing the locally elected Boards of Education and the Superintendents.

I found out about this last night – I let my Superintendent know. Here in Georgia, we start school early in August so although there is very little time before 9/8/09 – we have a chance of letting our parents know so they can opt out. I will most likely lose any protest against showing it – although as a last ditch effort I will ask it be taped so we can discuss as a Board whether or not to show it. But what about the school districts that start on Sept 8th? They have no time to let parents know so they can opt out.

Planned? I think so.

Perhaps its harmless, but Obama’s past behavior and his push for “service”  and community over individuals make me very uncomfortable….

My kids will be forced to listen to the views of a President that is perhaps the most anti-American in history, not to mention one who believes we need a “civilian national security force just as strong, powerful and well-funded as our military.”

Is this the service indoctrination speech? Something else? 

This is a President who believes in community above individuals and its clear in the talking points sent out to schools.

Obama is a follower of Saul Alinsky who wrote “Rules for Radicals”.

Alinsky held these views of organizing and “transforming” where teachers and education are concerned:

Alinsky believes that the teacher association’s real power base is not in the teachers, but in the community.  He does not see our task of organizing them as any different from those of his own community organizers.

Because he sees the teacher’s power base outside the membership and in the community, Alinsky offers a straight line route to organization of that power base

In other words, what Alinsky is looking at, is not the membership, but access teachers have to the community.  He sees that as a powerful weapon with which to organize. 

Is this part of Obama’s plans to reach the children to get to the adults like he is doing on the census?

Take a look at teacher talking points that are being distributed to accompany Dear Leader’s push for the mind of your kids on September 8….you decide what Obama is trying to teach your children without your participation and, likely, without the knowledge of many parents.

  Excerpts:

“Teachers can build background knowledge about the President of the United States and his speech byreading books about presidents and Barack Obama and motivate students by asking questions.”

….What is the President trying to tell me?
What is the President asking me to do?
What new ideas and actions is the President challenging me to think about?…..

……Students can record important parts of the speech where the President is asking them to do something.  Students might think about: What specific job is he asking me to do? Is he asking anything of anyone else?  Teachers? Principals? Parents? The American People?…..

……What do you think the President wants us to do?
Does the speech make you want to do anything?
Are we able to do what President Obama is asking of us?…..

…..Teachers can have students:
Create posters of their goals……It makes sense to focus on personal and academic so COMMUNITY and country goals come more readily……

What right does Obama have to tell my kids what their involvement in community should be?  What right does he have to ask ANY of our kids to do anything?

It’s one thing, as President, to go into ONE classroom and read a book to students…it’s quite another to take your “community organizing” propaganda to our kids in public school.

Kids are very impressionable, especially K through 6, which is why, I believe this is where this speech is targeted. Kids listen to their authority figures at school.

Call your school and tell them not to participate.

Of course, liberals will ask, “What is the big deal?” …..while even your less-informed friends may not give it a thought….well the reasons not to involve your kids is summed up nicely at AmericanElephant.com :

Now the former Community Organizer and current President of the United States is making an unprecedented speech to the school children of our nation.  I’d like to believe his motives were pure and politics didn’t play into this.  But viewing this administration’s track record doesn’t afford such benefit of the doubt.  When the President browbeats property owners who want to protect their legal rights… when the President admits he doesn’t know the facts but impugns the integrity of a police force… when the President calls me a liar for reporting what is actually in the health care bills and encourages my neighbors to report me to some enemies list… when the President apologizes to nations around the world and bows to a Saudi king… he loses the benefit of the doubt.  As a socialist who has surrounded himself with Marxist and racist radicals all of his life, he loses the benefit of the doubt.

Without benefit of the doubt, the President doesn’t get to speak to my children unchallenged.  Surely we can’t trust the school system to challenge him.  Surely we can’t trust the school system to protect the interest and rights of parents.  So on September 8, 2009, when President Obama seeks an unprecedented audience with the nation’s youth, I would have no choice but to deny him access to my child.

Parents, you are responsible for your children.  You are responsible for teaching them right and wrong, instilling personal responsibility and an understanding of the founding of our nation.  It is your job to raise your children, not the federal government.  And when a socialist with a radical agenda seeks an audience with them, it is your job, not the school’s, to protect them.  It is your values that should be taught to your children, not the political agenda of any President or any political party.  If you can’t be there to watch the President’s address with your children and challenge them on the content immediately afterward, then it is also your job to consider keeping them out of school that day.

As Jonah Goldberg expertly expounds in his book, Liberal Fascism, American left-wing ideologues have managed to dissociate themselves from all the horrors of fascism with a “brilliant rhetorical maneuver.” They’ve done it by “claiming that their opponents are the fascists.”

In what may eventually prove to be a devious rhetorical feat of monstrous proportions, while the left has been indulging and fostering the “Bush Is Hitler” meme, they may have just put a genuine ideological fascist heir in the White House.

There is inherent danger in making scurrilous comparisons (as were perpetrated unceasingly against George W. Bush), but there seem to be some very worrisome signs in the rise of Barack Obama that we Americans would be foolish to ignore.
